GENERAL TERMS AND CONDITIONS FOR ONLINE SALES
This page (together with our Privacy and cookies Policy, Web Site terms of use, My Order, Delivery charge and options, shopping online and our Legal Notice) provides you information about us and the legal terms and conditions (hereinafter, also referred to “Terms and Conditions”)though which we sell any of the products listed on our website (www.ruffonatural.com) (hereinafter, the “Website”).

These Terms and Conditions will apply to any contract for sale of our products by and between Hello The Nut and you. Please read these Terms and Conditions carefully and make sure that you understand them, before ordering any products from the Website.
If you refuse to accept these Terms and Conditions, you will not be able to order any products from the Website.
We amend these terms from time to time as set out in clause 13 (Changes to the Terms and Conditions). Every time you wish to order any product, please check the Terms and Conditions to ensure you understand the terms which will apply at that time.

1. PRELIMINARY PROVISIONS
1.1 Identity of the Seller
The Website is owned and operated by Hello The Nut sprl, a company incorporated and operating under the laws of Belgium, having its registered office in Klaprozenpad 2, 8301 Knokke-Heist, Belgium, registration number under the Register of Undertakings of Belgium and VAT registration number 0713.956.622,
1.2 Identity of the Purchaser
For the purposes of these Terms and Condition, the term “Purchaser” means the person who buys Ruffo Natural products (hereinafter, the “Products” and individually the “Product”) on the Website. To be eligible to purchase any Product on the Website, the Purchaser must be an end-consumer (i.e. an individual, not acting as a retailer) and must be at least 18 years old.
By placing an order, the Purchaser agrees:
  to purchase Product or Products on the Website;
that the purchase of Product or Products on the Website is unrelated to any professional activity and is limited to personal use;
 to not resell or distribute the Product or Products purchased on the Website or any samples.
1.3 Information on the Products
-The images of the Products on the Website are for illustrative purposes only.
-Although we have made every effort to display the colors accurately, we cannot guarantee that a device's display of the colors accurately reflects the color of the Products. The Products purchased by you on the Website may vary slightly from those images. The packaging of Products may also vary from that shown in images on our website
-All the Products shown on the Website are subject to availability.
-Hello The Nut will inform the Purchaser by e-mail as soon as possible if the product ordered is not available.
-Hello The Nut reserves the right to add new Products, remove Products or change their appearance or price at any time. In the absence of an error, the Information on the Products and prices applicable to the order will be those appearing on the Website at the time the Purchaser confirms the order.
-The Products and services available on the Website, and any samples thereof we may provide to you, are for personal use only. It is our policy that you may not sell or resell any of the Products or services, or samples thereof, you purchase or otherwise receive from us. Please note that samples are subject to availability. Where permitted by applicable law (as defined under article 10), we reserve the right, with or without notice, to cancel or reduce the quantity of any orders that we believe, in our sole discretion, may result in the violation of our Terms and Conditions.
-You may only purchase Products from our Website if you are at least 18 years old.

2. THE ORDER
2.1 Order Process
The Purchaser selects the Product(s) based on his/her choice and adds it/them under the heading “Your Basket”. He/she can check the details of the planned purchase and change them at any time.
The Purchaser must then validate his/her details, billing address, location and form of delivery and the selected payment method.
As soon as the Purchaser confirms his/her order by clicking on the “Confirm your payment” icon, the Purchaser is considered to have confirmed the contents and conditions of the order, the prices, characteristics, quantities and delivery deadlines for the ordered products. The order cannot be amended after this point.

2.2 Order confirmation
After the order is placed, Hello The Nut will send the Purchaser an e-mail summarizing the terms and conditions of the order. Please note that this does not mean that the order has been accepted. Hello The Nut’s acceptance of the order will take place when the Products are dispatched for delivery.
Orders can only be processed via the Website.
2.3 Unavailability of Products
If a Product the Purchaser has ordered is unavailable, Hello The Nut will inform the Purchaser before any other purchased products are dispatched. Only the Products which are dispatched will be invoiced.
2.4 Cancellation of the order
Hello The Nut reserves the right to cancel any orders at its discretion including without limitation:
 where the products are unavailable;
 where Hello The Nut has reason to believe that the Purchaser does not comply with the eligibility criteria set out in these terms;
 where the information provided by the Purchaser is incomplete or inaccurate;
 where the Purchaser fails to pay any amounts owed by it to Hello The Nut;
where there are events beyond Hello The Nut’s control as set out in clause 9 (Events outside Hello The Nut’s control).

The Purchaser may cancel his/her order by exercising his/her right of withdrawal under the conditions provided under clause 6 (Right of Cancellation).

3. PRICES
The sale prices of the Products are indicated with VAT included at the rate in effect on the day of the order and excluding delivery charges.
Hello The Nut takes reasonable care to ensure that the prices of Products are correct at the time when the relevant information was entered onto the system. However, if Hello The Nut discover an error in the price of Products ordered, Hello The Nut will notify the Purchaser of the correct price and if the Purchaser does not wish to purchase the Products at that price, the order will be cancelled.

4. PAYMENT CONDITIONS
Payment for Products can be made using a debit card, credit card or PAYPAL. Hello The Nut accepts the following cards: Visa, Mastercard, American Express. Payment by cheque is not accepted.
Payment for the Products and all applicable delivery charges is in advance. Hello The Nut will not charge the Purchaser’s debit card or credit card until the order is dispatched.
The entire transaction shall be effected in encrypted mode and the banking data of the Purchaser shall not transit via the Website.
Any person found to be using credit cards fraudulently on this website will be prosecuted.

If you choose to pay for your Order using a payment card with a foreign currency denominated account, the account will still be taken in euros (€) at the foreign exchange rate applied by your relevant credit card provider or bank at the time of processing your Order. Your international credit card provider or bank will determine the exchange rate and may add an additional processing or administration charge which you will be liable to pay.

- Hello The Nut is also entitled to discontinue any further deliveries to the Buyer until payment has been made. Repeated cases of payment failure by the Buyer entitle Hello The Nut to discontinue any further deliveries to him. Any claim by the Buyer shall not justify the Buyer to withhold payment for unpaid products

5. DELIVERY
5.1 Delivery procedures
The Products are only delivered in the EU.
When ordering, the Purchaser should choose the most convenient delivery method from amongst those proposed and, if required, should provide clear delivery instructions if the delivery address is difficult to locate or access.
5.2 Delivery deadlines
The delivery time of the Products will depend on the option selected by the Purchaser when placing the order, and will in any event be within thirty (30) days of order, except if affected by events beyond Hello The Nut’s control as set out in clause 10 (Events outside Hello The Nut’s control). Any delivery dates are estimates only and Hello The Nut does not guarantee that delivery will occur on the given date.
If no one is available at the delivery address to take delivery, the delivery driver will leave a note with details of how to rearrange delivery or collect the products. If the Purchaser does not collect the products or does not take delivery of the Products within a reasonable period and the order is returned to Hello The Nut, Hello The Nut will be entitled to treat the order as having been cancelled and will refund the amount of the order.

5.3 Verification of the order on receipt
The Purchaser should check immediately the condition of the package upon delivery. If the Purchaser has any concerns regarding the condition of the package or if any products are missing from the order or are incorrect or faulty, the Purchaser should inform immediately the delivery driver and notify the concerns on the delivery slip or, if this is not possible, should notify Hello The Nut’s Customer Service Team as soon as possible.
The Hello The Nut products will be the Purchaser’s responsibility from the completion of delivery. The Purchaser will own the Hello The Nut products once they have been delivered provided that Hello The Nut has received payment in full, including all applicable delivery charges.
A Product will be your responsibility from the time the Product is delivered to the address you gave us.

6. RIGHT OF CANCELLATION
6.1 Right of cancellation
The Purchaser has the legal right to cancel their order and withdraw from the contract without reason within the period of fourteen (14) days of the date of receipt of his/her order. If that fourteen (14) day period expires on a Saturday, a Sunday or a public holiday, the deadline will be extended until the following business day.
In order to exercise this right, the Purchaser shall, before the expiry of the fourteen (14) day deadline, inform Hello The Nut of his/her desire to cancel the contract. This may be done using the methods below (but these methods are not obligatory):
completing the return form if contained in the package;
sending a letter or e-mail addressed to Customer Service and including the following information: name, postal address and, if available, the Purchaser’s telephone number, order number and e-mail address
if they become unsealed after delivery
your right to return goods does not apply to goods (i) made to your specification; or (ii) which have been clearly personalised (e.g. by being engraved) or (iii) which by reason of their nature cannot be returned or are liable to deteriorate or expire rapidly or (iv) where sealed goods have been supplied which are not suitable for return due to health protection or hygiene reasons, if they become unsealed after delivery
If you are e-mailing us, calling us, or writing to us please include the details of your order to help us to identify it. A copy of a cancellation form may be included in your Dispatch Confirmation and may also be included in hard copy form with your order packaging.
6.2 Return of Products
Where the Purchaser exercises their right to cancel, they must return the cancelled products to Hello The Nut within fourteen (14) days of the date of cancellation. Unless the products are incorrect, mis-described or faulty at the time of delivery, the Purchaser will be responsible for the cost of returning the products to Hello The Nut.
The products should be returned complete but not partial and in good condition, where possible in the original packaging. All returns should be sent to the following address: 55-9, Boulevard de la Cambre, 1000. Bruxelles BE, accompanied by the return form (available under the Your Account heading on the Website or inserted into the package).
For reasons of hygiene, cosmetic products (care products, perfumes and make-up) must be returned intact, in good condition, unopened and in a condition which is suitable for resale. Opening these products will make them unsuitable for future resale. Failing to return the complete and original packaging will also reduce resale value, and the Purchaser’s refund may be reduced to reflect this.
If any free or multi-purchase discount products were included in the cancelled order, these must also be returned with the cancelled products.
The Purchaser should retain the proof of postage and provide it to Hello The Nut in the unlikely event that Hello The Nut does not receive the returned products.
The products should be returned in good condition and the Purchaser has a duty to take reasonable care of the goods.
If a Product has been dispatched to you or you have received them before you decide to cancel your Contract:
(a) then you must return it to us without undue delay (in the original product packaging if possible) and in any event not later than 14 days after the day on which you let us know that you wish to cancel the Contract;
(b) You can send it back to our local affiliate with a completed cancellation form;
(c) When returning goods please obtain a proof of postage (we do not accept responsibility for goods lost in transit) and ensure that the parcel is adequately sealed;
(d) Customers wishing to return fragrance Products should have regard to any labelling and packaging guidelines produced by your local courier; and
(e) unless the Product is faulty or not as described you will be responsible for the cost of returning the Products to us.
If you cancel your order but do not send off such goods to us within 14 working days of notifying us of cancellation, we shall be entitled to withhold payment of any refund.

6.3 Reimbursement following cancellation
Hello The Nut will refund to the Purchaser the amount paid for the cancelled products together with the delivery charges within a maximum period of 14 (fourteen) days from the qualitative and quantitative verification of the returned products.
Refunds will only be made against the original debit card or credit card used.

7. OTHER RETURNS – DAMAGED, FAULTY, INCORRECT ITEMS
Hello The Nut hopes that its Purchasers are very happy with the Products. Hello The Nut are under a legal duty (under the Consumer Rights DIRECTIVE 2011/83/EU ) to supply Products that are as described, fit for purpose and of satisfactory quality. Nothing in these terms will affect the Purchaser’s legal rights. In the unlikely event that a Purchaser receives a product which does not comply with these requirements, please contact Customer Service and then return the product to Hello The Nut sprl, 55-9 Boulevard de la Cambre, 1000 Bruxelles BE, accompanied by the return form (available under the Your Account heading on the Website or inserted into the package).
If the Products do not comply with those requirements, the Purchaser will receive a full refund of the price of the Products together with the applicable delivery charges and the cost of postage or collection.
If you cancel your Contract our local affiliate will:
(a) refund you the price you paid for the Products. However, as permitted by law, your refund may be reduced to reflect any reduction in the value of the goods, if this has been caused by your handling them in a way which would not be permitted in a shop (or you can choose to have such goods returned to you within 14 days of our notification that we intend to make a deduction). If you are refunded the price paid before we are able to inspect the goods and later discover you have handled them in an unacceptable way, you must pay us an appropriate amount.
(b) refund any delivery costs you have paid, although, as permitted by law, the maximum refund will be the costs of delivery by the least expensive delivery method we offer.
(c) make any refunds due to you as soon as possible and in any event within 14 days after the day on which our local affiliate receives the Products back from you or, if earlier, the day on which you provide evidence that you have sent the Products back to our local affiliate.
(d) Your refund will be to the credit card or debit card used by you to pay. If you used vouchers to pay for the Products your refund may be in vouchers. You will receive email notification of your refund from our Customer Service Team

8. LIABILITY
Hello The Nut only supplies Products via the Website for domestic and private use. The Purchaser agrees not to use any products purchased from the Hello The Nut Website for any commercial, business or re-sale purposes.
The Purchaser should ensure that they have read the label before using any Hello The Nut products and comply with any instructions for using the Hello The Nut products.
If Hello The Nut fails to comply with these terms or is negligent, Hello The Nut will be responsible for any loss or damage which the Purchaser suffers that is a foreseeable result of Hello The Nut’s breach of these terms or its negligence, but will not be responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of Hello The Nut’s breach or if, at the time the products were dispatched, both Hello The Nut and the Purchaser knew it might happen.
Hello The Nut does not in any way exclude or limit its liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation or in any other circumstances which are not permitted by law (including for breach of the Purchaser’s legal rights in relation to the products).

9. EVENTS OUTSIDE HELLO THE NUT’S CONTROL
Hello The Nut will not be liable or responsible for any failure to perform, or delay in performance of, any of Hello The Nut’s obligations under its contract with the Purchaser that is caused by events outside of Hello The Nut’s reasonable control.

10. GENERAL
Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.
If Hello The Nut fail to insist that the Purchaser perform any of its obligations under these terms, or if Hello The Nut do not enforce its rights against the Purchaser, or delays in doing so, that will not mean that Hello The Nut has waived its rights against the Purchaser and will not mean that the Purchaser does not have to comply with those obligations.
These terms are governed by Belgian law. This means that the contract for the purchase of Hello The Nut products through the Website and any dispute or claim arising out of or in connection with it will be governed by Belgian law. The Purchaser and Hello The Nut agree that the courts of Belgium will have non-exclusive jurisdiction.

11. USE OF THE WEBSITE AND USE OF PERSONAL INFORMATION
The Purchaser’s use of the Website is governed by the terms set out in the Legal Notice page.
By using the Website you are fully accepting the terms, conditions and disclaimers contained in this notice.
Hello The Nut will only use the Purchaser’s personal information in accordance its Privacy Policy and Cookies Policy.
The Purchaser should take time to read these documents as they contain important terms which apply to the Purchaser.

12. LINKS TO THIRD PARTY WEBSITES

The Website may include links to third party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and you acknowledge and agree that we are not responsible for the content or availability of any such sites.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.


13. CHANGES TO THESE TERMS
Hello The Nut may revise these Terms and Conditions from time to time including without limitation in the following circumstances:
to make changes to the order and delivery process;
to make changes to the way in which payment is accepted;
to reflect changes in relevant laws and regulatory requirements.
change or remove (temporarily or permanently) the Website or any part of it without notice and you confirm that Hello The Nut shall not be liable to you for any such change or removal and.

Every time a Purchaser places an order for Ruffo Natural products, the terms in force at that time will apply to the contract between Hello The Nut and the Purchaser. 

14. COPYRIGHT
14.1  All copyright, trade marks and all other intellectual property rights in the Website and its content (including without limitation the Website design, text, graphics and all software and source codes connected with the Website) are owned by or licensed to Hello The Nut or otherwise used by Hello The Nut as permitted by law.

14.2  In accessing the Website you agree that you will access the content solely for your personal, non-commercial use. None of the content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of the copyright holder. This excludes the downloading, copying and/or printing of pages of the Website for personal, non-commercial home use only.
If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.

15. TRANSFER OF RIGHTS
We may transfer our rights and obligations under these Terms and Conditions to an affiliate or another organisation, and we will always notify you in writing if this happens, but this will not affect your rights or our obligations under these Terms and Conditions. You may only transfer your rights or your obligations under these Terms and Conditions to another person if we agree in writing.

According to EU Regulation no.524/2013 on online dispute resolution for consumer disputes, you may refer disputes to the EU Commission’s online platform.
